    • I am unsure if Alexander and Penelope married in Kirkcubright before leaving or perhaps they married onboard the "«i»Emperor«/i»" I have never been able to find a record for their marriage as yet. Family stories have it that they married then a couple of months after the marriage sailed for Australia. On the birth records of their children it states they where married 7 Feb 1851 in Kirkcudbright.

    • John being the eldest child of 10 children 3 sisters Bess, Penelope and Mary and 6 brothers Peter, Alexander, George, William, Archibald and Fergus born to Alexander and Penelope Frater (nee Hay) inherited his Grandfather and great Grandfathers name being John.
      John also had a daughter before he married and she was bought up by his parents as a child of their own. It was later in his daughters life before she found out that she was Johns daughter. «b»


      Last Will and Testament of John Frater made on the 26th May 1921.«/b»
      THIS IS THE LAST WILL AND TESTAMENT of me JOHN FRATER of "Cheviot Hills" near Narrabri in the State of New South Wales Grazier I revoke all former wills codicils and testamentary dispositions heretofore made by me and declare this to be my last will and testament I Appoint my Brothers WILLIAM DENNE FRATER and GEORGE SIDNEY FRATER both of Narrabri afore said Graziers here in after referred to as my said Trustees to be Executors and Trustees of this my will. I GIVE AND BEQUEATH my property known as "Cheviot Hills" near Narrabri together with all live stock thereon and all other personal property thereon and used in connection therewith to my Trustees Upon Trust to carry on my business of a Grazier as now carried on by me during the lifetime of my Son OSCAR BRUCE FRATER and after his death till my Grandsons JOHN FRATER and GORDON FRATER (sons of the said Oscar Bruce Frater) have each attained the age of twenty one years or in the event of one of them dying before attaining the age of twenty one then until the survivor shall attain that age. I direct that for the purpose of carrying on such business my said Trustees shall have the fullest powers of management with power to buy and sell livestock wool and produce therefrom and pay all outgoings in respect of the said business with power also to let and lease the said property for any term of years at the best rent obtainable to erect pull down and repair houses and other buildings erections and improvements upon the said lands to convert Conditionally Purchased lands into freehold and to convert any Conditionally Leased lands into Conditionally Purchased lands and to acquire further or additional land with power also to employ the said Oscar Bruce Frater and either or both of his said Sons as Manager or otherwise of the said business at a usual and proper wages or salary. AND I DIRECT that all outgoings in connection with the carrying on of the said business, including the interest and installments due to the Commissioners of the Government Savings Bank under the mortgage on the said lands shall be paid out of the income derived therefrom with power also for my said Trustees to convert any part of the capital of business into money for the purpose of paying such outgoings. AND I DIRECT my said Trustees to stand possessed of the net annual income derived from the said business UPON TRUST for my Son Oscar Bruce Frater during his life and after his death to accumulate same until John Frater and Gordon Frater or survivor of them attain the age of twenty one years and upon the happening of such last mentioned event or upon the death of Oscar Bruce Frater whichever event shall last happen to stand possessed of the said property livestock and other personal chattels UPON TRUST for the said John Frater and Gordon Frater absolutely share and share alike and in the event of either of them dying under the age of twenty one years the then UPON TRUST for the survivor absolutely I GIVE AND BEQUEATH the unsold portions of my Sans Souci Estate to my said Trustees UPON TRUST to sell call in and convert the same into money on such terms and conditions as my said Trustees may deem prudent with power to postpone such sale for so long as they may think fit AND I DIRECT my said Trustees to stand possessed of proceeds of such calling in and conversion together with all other moneys which they shall receive from the Purchasers of Portions of my San Souci Estate sold by me in my lifetime UPON TRUST to invest the same upon any of the investments hereinafter mentioned AND to pay the income arising therefrom to my wife during her life and from and after her death to stand possessed of same. UPON TRUST to pay there out the sum of five hundred Pounds to my Daughter HOLLY PENELOPE FRATER and to stand possessed of a further sum of five hundred Pounds UPON TRUST for such of the children of my Daughter Ivy Lucinda Mackay who being males have attained or shall attain the age of twenty one years or being females have attained or shall attain that age or marry and if more than one in equal shares I GIVE AND BEQUEATH all the rest and residue of my real and personal estate of whatsoever kind and where so ever situate to my said Trustees UPON TRUST after payment there out of my debts (other than the Mortgage hereinbefore mentioned) funeral and testamentary expenses and Probate and estate duties for all my children (other than my Son Norman) who may be living at the date of my death in equal shares share and share alike and I DECLARE that I have made provision for my Son Norman during my lifetime and have expended sums of money in improving the property now owned by him and I DECLARE that my said Trustees may in their absolute discretion utilise the whole or any part of the share either in capital or income to which any infant may be entitled under this my will in the maintenance education and advancement of such child and I DIRECT that all money liable to be invested under this my will may be invested in or upon any stock funds or securities of the Government of any of the Australian States or in shares or upon fixed deposit in any public Bank or Company (other than Mining Companies) in any of the Australian States or upon mortgage of real estate or in the purchase of real estate in any of the said States or in any mode or investment authorized by the Court of Equity with liberty for my said Trustees to vary or transpose such investments into or for others of the same or a like nature hereby determining whether any moneys are to be treated as capital or income and generally of determining all matters as to which any doubt difficulty or question may arise under or in relation to the execution of matters as to which any doubt difficulty or question may arise under or in relation to the execution of the trusts of this my will. AND I DECLARE that my said Trustees may if the think fit accept any composition or any security real or personal for any debt or for any property real or personal claimed and may allow any time for payment of any debt and may compromise compound abandon submit to arbitration or otherwise settle any debt account claim or thing whatever relating to my estate or to the trusts of this my will and for any of those purposes may enter into give execute and do such agreement instruments of composition or arrangement releases receipts and other things as to them shall seem expedient without being responsible for any loss occasioned by any act or thing so done by them in good faith. AS WITNESS my hand at Narrabri this twenty sixth day of May in the year One thousand nine hundred and twenty one.

      THIS IS A CODICIL to the last will and testament of me JOHN FRATER of Cheviot Hills near Narrabri in the State of New South Wales Grazier which will bears date the twenty sixth day of May in the year one thousand nine hundred and twenty one WHEREAS since the date of my will I have acquired from Walter Henry Frater the property known as "Glengowen" for which no special provisions has been made by my said will for the disposal thereof NOW I HEREBY GIVE AND BEQUEATH such property known as "Glengowen" near Narrabri together with all the livestock thereon and all other personal property thereon and used in connection therewith to my said Trustees subject to all the trusts and directions in my said will contained respecting my property known as "Cheviot Hills" and so that such property known as "Glengowen" shall be held upon trusts and subject to the same directions as in such will expressed as relate and attached to my property known as "Cheviot Hills" AND WHEREAS by my said will I directed that the interest and installments due to the Commissions of the Government Savings Bank of New South Wales payable under the mortgage on my property known as "Cheviot Hills" should be paid out of the income derived therefrom AND WHEREAS I am the owner of Policy Number 19327 on the life of S. Callan in the National Mutual Life Association of Australasian Limited AND WHEREAS by my said will the proceeds of such Policy form part of my residuary estate and stand charged with the payment of my debts other than the said mortgage on "Cheviot Hills" NOW I HEREBY REVOKE my said will so far as destination of the proceeds of such Policy are concerned and I DIRECT my said Trustees to stand possessed of the proceeds of such Policy upon trust to apply same in the reduction of the said Mortgage on "Cheviot Hills" and also in reduction of the mortgage on "Glengowen" held by the Commissioners of the Government Savings Bank of New South Wales on each property AND in all other respects I HEREBY CONFIRM my said will. AS WITNESS my hand at Narrabri aforesaid the First day of May in the year one thousand nine hundred and twenty four. JOHN FRATER
